General Provisions
The information export support Portal Export.by, placed on the website www.export.by (hereinafter referred to as — Portal) is the main informational resource of the Republic of Belarus in the Internet global computer network in the sphere of information export support, development of international trade and economic cooperation and e-commerce.
1. Terms and Definitions, applied in the present Rules:
1.1. User — a legal body (individual entrepreneur), using the Portal and giving the consent to the present Rules;
1.2. Moderator — is a staff member of the Informational National Unitary Enterprise “National Centre for Marketing and Price Study”, conducting Moderation;
1.3. Moderation — Moderator’s activities, aimed at Users' compliance with the present Rules;
1.4. Administration — Informational National Unitary Enterprise “National Centre for Marketing and Price Study”;
1.5. Information — any data, texts, graphical images, photographs, software, databases or data from databases in any form and volume, placed on the Portal;
1.6. User Account — data collection, allowing to identify the User, including information about goods (services), technologies, User’s Events and Messages;
1.7. Events — the module of the Portal, that displays different events, filled in by the Moderator or the User;
1.8. Messages — the module, which is made as the mailbox for Messages exchange between Users and the Administration;
1.9. Registration form — A collection of fields for filling out by the User, during the registration on the Portal;
1.10. FEACN — is a unique ten-digit classification commodity code under the Commodity Nomenclature of Foreign Economic Activity of the Eurasian Economic Union;
1.11. EAN13 code — a graphical presentation of a unique international commodity code EAN/UCC-13 in the form, suitable for the automatic bar-code reading. EAN13 number value is duplicated by Arabic numerals at the bottom of the bar-code (13 digits).
2. Agreement with the present Rules:
2.1. Registration on the Portal, and also its use without registration, is considered as acceptance of the present Rules by the User.
3. Rights and Obligations:
3.1. Rights and Obligations of the User:
3.1.1. The User is entitled to use all the resources of the Portal;
3.1.2. The User is entitled to obtain free consultations on using the Portal by phone or by e-mail, as provided by subparagraph 5.3 of the present Rules;
3.1.3. The User is entitled to make proposals for amendments and supplements to the functionality of the Portal;
3.1.4. The User agrees to comply with the present Rules;
3.1.5. In case of disagreement with the present Rules, the User is obliged to refuse any further use of the Portal;
3.1.6. The User is obliged to provide true, accurate and complete information during the procedure of registration under the Registration form;
3.1.7. The User is obliged to fill in all the fields according to the questions in the Registration form during the procedure of registration and when adding goods (services), technologies and Events;
3.1.8. The User is obliged not to take actions, aimed at undermining the network security or disrupting the operation of the Portal, soft hardware of the Administration;
3.1.9. The User, when using the Portal is obliged to observe the legislation of the Republic of Belarus, act reasonably and in good faith. The Information provided shall not violate the legislation of the Republic of Belarus;
3.1.10. By placing information on the Portal, the User confirms the fact of having all necessary rights for it, non-infringement of the rights of third parties and non-violation of laws and regulations of the Republic of Belarus;
3.1.11. The User may not copy, process, distribute, publish, download, transmit, transfer or otherwise use the Information in part or in full on the Portal, being placed on the Portal by other User or the Administration, without prior permission of the other User (rights holder, who is not the User) or the Administration, received in writing;
3.1.12. The User undertakes not to use the Portal:
• For infringement of intellectual property rights;
• For insults, libel, derogation of honour, dignity and goodwill of other Users;
• For publication of the materials with sexual content;
• For incitement of ethnic hatred;
• For making appeals for unconstitutional change of power;
• For publication of the information about manufacturing of explosives, organizing of terrorist acts;
• For publication of the information about the ways of committing suicide;
• For publication of State secrets and trade secrets;
• For publication of other Information, that obviously or accidentally may cause harm to any person, which includes spamming;
• For publication of personal data of third parties without their consent;
• For sale or informing about drugs, psychotropic substances and their precursors.
3.1.13. The User is obliged to control the login and password, which are necessary for sending Messages and for carrying out other actions using the User’s Account and any actions on the Portal, carried out using the User’s Account, are regarded by the Administration solely as the User’s actions, but not the actions of third parties, which could obtain the control over the User’s Account in any manner. The User is entirely responsible for all activities, committed under the User’s Account.
3.1.14. The User is also obliged:
• Not to change the entire software of the Portal, or any of its part in any way;
• Not to gain access to the Portal with the rights which allow to control the Portal or any of its part;
• Not to expose the Portal to the impact of any malware.
3.1.15. No registration of the User on the Portal is allowed more than once (re-registration). By using the search function, the User is obliged to check whether this User has already been registrated on the Portal.
3.2. Rights and Obligations of the Administration:
3.2.1. The Administration is entitled to store the information about all the connections of the User, including IP addresses used by the User while visiting the Portal and the addresses of the requested pages;
3.2.2. In case of violation of the present Rules by the User, the Administration is entitled to suspend or to cease the User’s rights on using of the Portal, and in cases, when the information provided by the User in the Registration form is considered untrue by the Administration;
3.2.3. The Administration is entitled to extend functionality of the Portal, to change the scope, patterns and methods of using the Portal, including the right to set technical restrictions: the number of personal messages the size and number of attachments the list of supported protocols, port numbers being used, and other technical characteristics and parameters;
3.2.4. The Administration is entitled to change the technical characteristics and parameters of software and hardware, involved in the work of the Portal, in a planned or unplanned manner, including the temporary suspension of the work of the Portal;
3.2.5. The Administration is entitled to send service messages to Users, concerning, in particular, the issues of functioning of the Portal, changes of the given Rules, warnings, cautions, and actions of other Users of the Portal;
3.2.6. The Administration is entitled to delete the User’s Account in case of the unfinished registration within 30 calendar days;
3.2.7. The Administration assumes the obligations on consulting, supporting and updating of the Portal.
3.3. Rights and Obligations of the Moderator:
3.3.1. The Moderator is entitled to delete and change any information provided by the User of the Portal without a preliminary notification if this information does not meet the requirements of the present Rules;
3.3.2. The Moderator is obliged to carry out the consulting support on the issue of using the Portal by telephone and / or by e-mail in the way as it is provided by paragraph 5.3 of the present Rules.
4. The requirement for filling in of the User’s Account:
4.1. The company’s profile:
4.1.1. The full name of the company, containing the full corporate name of the User, as provided by the constituent documents, should not exceed 250 characters;
4.1.2. The short name of the company, containing the short corporate name of the User, as provided by the constituent documents, should not exceed 250 characters;
4.1.3. It is forbidden to write down the full and short name of the company in capital letters;
4.1.4. The company’s profile, containing the description of the company's activities, should be of a textual format. The data amount is restricted up to 4000 characters;
4.1.5. The trademark image should be provided in .jpg, .jpeg, .png, gif formats with the image size of up to 3 MB;
4.1.6. It is forbidden to use the trademark with copyright infringement;
4.1.7. It is forbidden to use the images of real individuals as a trademark or a part of it without their written consent;
4.1.8. It is forbidden to use frequently flashing or changing the color images as a trademark or a part of it;
4.1.9. It is forbidden to place links to any Internet resources in the "Description" field.
4.2. Goods (services), technologies:
4.2.1. The product (service), technology name should be of a textual format with the size of up to 250 characters;
4.2.2. The product (service), technology name must not violate the legislative requirements of the Republic of Belarus;
4.2.3. It is forbidden to use website addresses, domain names, links to third-party resources, and rude, abusive and obscene language in the product (service) or technology name;
4.2.4. It is forbidden to write down the product (service), technology name in capital letters;
4.2.5. It is forbidden to use the product (service), technology name, which is identical or similar to the extent of confusion with the product (service), technology name of the other User;
4.2.6. It is forbidden to use in the product (service) and technology name advertisements, links that are given for advertising purposes, convert advertising of the products (services), technologies, trademarks and other means of individualization of the parties to a civil transaction, owned by third parties;
4.2.7. A minimum order should contain information about a minimum batch of goods with an indication of measuring units. Data amount is restricted to 250 characters;
4.2.8. Packaging should contain information about product packaging used in product delivery. Data amount is restricted up to 250 characters;
4.2.9. Terms of delivery should contain information about the terms of delivery being used in accordance with Incoterms;
4.2.10. Price should contain information about the product (service), technology price for a measuring unit;
4.2.11. The brief information and characteristics of the product (service), technology, containing the description of the product (service), technology should be of a textual format. The data amount is restricted up to 1000 characters;
4.2.12. The full information, containing the description of the product (service), technology should be of a textual format. The data amount is restricted up to 2000 characters;
4.2.13. The full and brief information about the product (service), technology must not violate the legislative requirements of the Republic of Belarus;
4.2.14. Key words should contain a list of words on which the User can find the information about the other User, products (services), technologies in the catalogues of the Portal;
4.2.15. The products (services), technologies image should be provided in .jpg, .jpeg, .png formats with the image size of up to 3 MB;
4.2.16. It is forbidden to provide the links to any Internet resources in the full or brief information about the product (service), technology;
4.2.17. It is forbidden to use frequently flashing or changing the color images as the image of the product (service), technology;
4.2.18. It is forbidden to use the images of the product (service), technology with copyright infringement;
4.2.19. It is forbidden to use the images of real individuals as the product (service), technology image without their written consent;
4.2.20. The product (service), technology image must comply with the requirements of the legislation of the Republic of Belarus on advertising.
4.3. Events, offers:
4.3.1. The “Event Name” ( "Offer name") field should contain the official short name of the Event (offer), including in the form of an abbreviation (if available), with the size of up to 250 characters;
4.3.2. The “Brief description of the Event” field should contain the full official name of the event;
4.3.3. The “Full description of the Event” field should contain the description of the event, giving the duration and place of the event, the categories of exhibited goods, simultaneously held events;
4.3.4. The Event (offer) image should be provided in .jpg, .jpeg, .png formats with the image size of up to 3 MB;
4.3.5. It is forbidden to use the images of real individuals as the Event (offer) image without their written consent;
4.3.6. It is forbidden to use the Event (offer) image that violates third-party copyrights;
4.3.7. It is forbidden to use frequently flashing or changing the color images as the image of the Event (offer);
4.3.8. The comments for the administrator might contain the message to the Administration with any important information, concerning the holding of the event.
4.4. The rules of writing Messages:
4.4.1. While writing Messages, the User is entitled to use the Russian, Belarusian or English language. It is forbidden to send Messages with a lot of grammatical errors and slang language;
4.4.2. Trade secret and State secret shall be observed while writing Messages. It is forbidden to send Messages, containing the information for limited distribution in accordance with the legislation, any contract or agreement;
4.4.3. It is forbidden to send Messages which can foster incitement of ethnic hatred;
4.4.4. It is forbidden to send Messages which violate the legislation of the Republic of Belarus or contain proposals for anyone to do it;
4.4.5. It is forbidden to send Messages, dedicated to the discussion of the Administration’s actions or the Moderator’s actions or personality;
4.4.6. It is forbidden to send Messages, containing the statements of a political nature;
4.4.7. It is forbidden to send Messages, containing unsubstantiated information that can cause harm to honor dignity and business reputation of an individual entrepreneur or a legal, deliberately given misleading information, defamation;
4.4.8. It is forbidden to send Messages, containing rude, obscene expressions, insults in any form, and also criticism of the products (services), technologies and companies.
4.5. The requirements for the attachments of the Messages:
4.5.1. The size of files being attached must not exceed 3 MB;
4.5.2. The attached files are subject to all the requirements of the present Rules concerning images, Events and Messages;
4.5.3. When attaching the files, all copyrights of third parties shall be observed. It is forbidden to attach files which violate the copyrights of third parties;
4.5.4. It is forbidden to attach files without obvious notional correlation with the text of the Message;
4.5.5. It is forbidden to attach files, containing the information for limited distribution in accordance with the legislation, any contract or agreement.
5. Moderation:
5.1. Compliance with the present Rules is monitored by the Moderators and the Administration. The Moderators and the Administration are entitled to delete any information provided by the User of the Portal at any time and without a preliminary notification;
5.2. The decisions of the Administration and (or) the Moderators on all the matters are final and not subject to appeal;
5.3. The Portal’s Moderation and contacts with the Administration are carried out by means of e-mail: info@export.by from Monday to Thursday, from с 9.00 a. m. to 6.00 p.m., on Friday — from 9.00 a.m. to 4.45 p. m, lunch hours — from 01.00 p. m. to 01.45 p. m.
6. Liability. Limitation of liability:
6.1. The Users are fully responsible for the Information being provided;
6.2. The Administration is not responsible for the accuracy and legality of the Information presented on the Portal;
6.3. In the cases provided by the legislation, The Administration provides information about the Users, placing the Information, to law enforcement, tax and judicial authorities of the Republic of Belarus;
6.4. The Users, placing the Information, at the request of the Administration and (or) the Moderator are obliged to bring evidence of its rightfulness and legality;
6.5. The functioning of the Portal is provided on “as is” basis, The Administration cannot provide the assurance on the quality of the functioning of the Portal. The Administration is not responsible for the accuracy of the information on the Portal, it also does not guarantee the security of the Portal (including the absence of viruses), operational continuity, the absence of failures and errors and external interference in the functioning of the Portal. The Administration does not guarantee the operation of the Portal 24 hours a day;
6.6. The Administration is not responsible for any Information on the Portal, resulting from the Users’ work with the Portal, it does not monitor the appearance of such Information, and it is not responsible for any possible harm that might be caused by such Information. The Administration does not guarantee the Information provided by the Users on the Portal to be full, useful and true, and it is not responsible for such Information;
6.7. The Administration does not guarantee the Portal to be compatible and (or) to operate with any software of the User’s computer;
6.8. The Messages of the Users of the Portal might contain links to other resources. The Administration is not responsible for proper functioning of the resources, as well as for the content, advertisements, materials, goods (services) that are available on such resources. The Administration is not responsible for any harm that might be caused to the User by third parties, having placed such links.
7. Copyrights:
7.1. The User confirms the fact of having all necessary rights for placing the Information;
7.2. When placing the Information on the Portal, the User grants to the Administration the rights to use it in any form and manner;
7.3. Third parties, when using (citing) the Information from the Portal, are obliged to get the consent from the Users, having placed the Information, and in all cases to place a link to the Portal.
8. Changes to the present Rules:
8.1. The present Rules are changed by the Administration unilaterally, as required, without the Users’ consent and the preliminary notification to them about it;
8.2. In case of disagreement of the User with the amended changes and (or) additions the User is entitled to refuse any further use of the Portal. If the User makes the use the Portal after the date of the changes to the present Rules, The Administration will recognize this fact as agreement with the amended Rules;
8.3. The current edition of the Rules is always available at https://export.by/en/siterules. The User must check the Rules for changes independently.
